UPON reviewing the Applicant’s letter application dated 22 June 2022 requesting to see a copy of Schedule C (the“Schedule”) of the Order of Justice Wayne Martin dated 22 April 2021 (the“Application”)

AND UPON the Registry having circulated the Application to the Claimant and Defendant in CFI-061-2020 for comment on 27 June 2022

AND UPON the Claimant’s response to the Application dated 5 July 2022 that it has no objection on the Application but would like more information as to the identity of the parties which the Applicant is representing in order to understand the purpose of the Application and the proposed use of the material

AND UPON the Applicant’s reply dated 6 July 2022 that they cannot disclose the name of the parties due to confidentiality and privilege

IT IS HEREBY ORDERED THAT:

1. The Application is dismissed on the basis that the Schedule is private and the Applicant has shown no compelling reason to compromise the privacy of the Schedule.

2. No order as to costs.

3. Liberty to apply.
